An Ogun State High Court sitting in Ijebu-Ode has refused to grant an interim injunction sought by the prominent Fuji musician, Wasiu Ayinde Marshal, also known as KWAM1, to stop the selection and installation of the next Awujale of Ijebuland. Justice A. A. Omoniyi dismissed the ex parte application on Monday, 22nd December 2025, holding that the musician failed to disclose sufficient grounds to warrant such a restrictive order. The court emphasised that KWAM1 did not provide an undertaking as to damages, which is a vital legal requirement for an interim injunction.
KWAM1, represented by Senior Advocate of Nigeria Wahab Shittu, had filed the suit seeking to restrain Governor Dapo Abiodun and the Fusengbuwa ruling house from proceeding with the succession process. The musician declared his interest in the vacant stool, claiming lineage from the Jadiara Royal House. However, the Fusengbuwa ruling house rejected his claim, insisting that he is not a member of the royal family entitled to the throne. Following the court’s refusal to grant the injunction, KWAM1 filed a Notice of Discontinuance to withdraw the suit entirely, effectively ending his legal challenge.
The case, marked HC3/238/2025, named several high-ranking officials as respondents, including the Chairman of the Ijebu-Ode Local Government, Dare Alebiosu, and the Commissioner for Local Government and Chieftaincy Affairs, Ganiyu Hamzat. The Chairman of the Awujale Interregnum Administrative Council, Dr Olorogun Sunny Kuku, was also among the defendants. Justice Omoniyi noted that granting an interim order while a substantive suit is pending—without following the correct procedure of filing a motion on notice—would be a violation of established legal principles.
Despite the withdrawal of the application, the court has fixed 14th January 2026 for further proceedings to formally record the discontinuance and address any consequential orders. The Awujale of Ijebuland remains one of the most influential traditional positions in Yorubaland, and the selection process has attracted significant national interest. With KWAM1’s exit from the legal battle, the state government and the ruling house are now expected to proceed with the traditional rites for the installation of a new monarch.
